Corporate Boundaries & City Utilities
In 2002, the City of Hagerstown adopted an Annexation Policy that requires properties located outside the corporate boundaries to annex into the city as a condition of receiving city water and sewer service.

Applicants requesting city water and sewer service, who are located outside the city and within the Hagerstown Medium Range Growth Area, must submit an application form and review fee and a pre-annexation agreement to the city’s Planning Office. The Medium Range Growth Area is identified in the Land Use & Growth Management Element of the Comprehensive Plan. The staff review the request for consistency with the Annexation Policy and usually requires, as a condition of receiving city water and/or sewer service, annexation for contiguous properties and submission of a pre-annexation agreement for properties that are not contiguous to the corporate boundary. Properties seeking city water and/or sewer service outside the City's Medium Range Growth Area must meet one or more of the exemptions outlined in the City's Water/Wastewater Policy. If service is granted through an exemption, an application form and review fee and a pre-annexation agreement must still be submitted to the city’s Planning Office.

Binding Agreements


The pre-annexation agreement binds the property owner to annex into the city if the city’s corporate boundaries extend to the property in the future. Persons seeking an exemption from these requirements may request review by the city's Annexation Review Committee. Persons aggrieved by a decision of the Annexation Review Committee may appeal the decision to the Mayor & City Council of Hagerstown.
